Terms of Service
The agreement between you and CCT Plus LLC for your use of Tobi.
1. Agreement
These Terms of Service (“Terms”) are a binding agreement between you and CCT Plus LLC (“we,” “us,” or “our”) governing your use of the Tobi app and related services (“Tobi” or the “Service”). By creating an account or using Tobi, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 13 years old (or 16 in the EEA and UK) and able to form a binding contract to use Tobi. If you use Tobi on behalf of a household or other group, you represent that you are authorized to do so.
3. Your account
You are responsible for the activity that happens under your account and for keeping your sign-in method secure. Sign-in is handled through Firebase Authentication using the methods we support (such as Sign in with Apple, Google, email and password, or phone). Notify us promptly at [email protected] if you believe your account has been compromised.
4. Households and shared content
Tobi is built for shared use. When you create or join a household, the maintenance items, history, notes, contractors, and schedules in that household are visible to, and may be edited by, the other members of that household according to their roles. You are responsible for who you invite and for the information you choose to share. Each household retains at least one owner; removing members and changing roles is governed by the in-app permissions.
5. Acceptable use
You agree not to:
- Use Tobi for any unlawful purpose or in violation of these Terms.
- Access, tamper with, or use non-public areas of the Service or its systems, or attempt to bypass our security or household authorization rules.
- Upload content that infringes others’ rights, is unlawful, or that you do not have the right to share.
- Interfere with or disrupt the Service, or place an unreasonable load on our infrastructure.
- Reverse engineer, resell, or commercially exploit the Service except as permitted by these Terms.
6. Your content
You retain ownership of the content you add to Tobi. You grant us a limited, non-exclusive license to host, store, process, and display that content solely to operate and improve the Service and to make it available to the members of your households. You are responsible for the accuracy of the information you enter, and for keeping your own records where you need them.
7. Not professional advice
Tobi is an organizational and record-keeping tool. It helps you track maintenance, history, and your electrical panel schedule — it does not provide engineering, electrical, safety, or other professional advice, and it is not a substitute for inspection or work by a licensed professional. Always consult a qualified professional for electrical, structural, or safety-related work, and follow applicable codes and manufacturer guidance. You are solely responsible for decisions you make based on information in the app.
8. Subscriptions and payments
Some features may require a paid subscription. Subscriptions are sold as in-app purchases through the Apple App Store and are managed by Apple; we use RevenueCat to administer subscription status. Payment is charged to your App Store account at confirmation of purchase.
- Auto-renewal. Subscriptions automatically renew at the then-current price unless canceled at least 24 hours before the end of the current period.
- Managing and canceling. You can manage or cancel your subscription in your App Store account settings. Canceling stops future renewals; it does not retroactively refund the current period.
- Refunds. Purchases are handled by Apple, so refunds are subject to Apple’s policies. We do not separately process App Store payments.
- Price changes. We may change subscription prices; any change applies to future billing periods and, where required, only after notice and your consent.
9. Third-party services
Tobi relies on third-party services — including Apple, Google Firebase, PostHog, RevenueCat, and Resend — to operate. Your use of the Service may be subject to those providers’ terms, and we are not responsible for third-party services we do not control. 10. Intellectual property
Tobi, including its software, design, branding, and content we provide (excluding your content), is owned by CCT Plus LLC and protected by intellectual property laws. We grant you a limited, personal, non-transferable, revocable license to use the Service in accordance with these Terms. We reserve all rights not expressly granted.
11. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that reminders or notifications will always be delivered on time. Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.
12. Limitation of liability
To the maximum extent permitted by law, CCT Plus LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, property, or profits, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or fifty U.S. dollars (US$50).
13. Indemnification
You agree to indemnify and hold harmless CCT Plus LLC from any claims, damages, liabilities, and expenses arising out of your use of the Service, your content, or your violation of these Terms or applicable law.
14. Termination
You may stop using Tobi and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or other users. Provisions that by their nature should survive termination — including ownership, disclaimers, limitation of liability, and indemnification — will survive.
15. Changes to the Service and Terms
We may modify the Service or these Terms from time to time. When we make material changes to the Terms, we will update the “Effective” date above and provide reasonable notice within the app or by email. Your continued use of Tobi after a change takes effect means you accept the updated Terms.
16. Apple App Store
These Terms are between you and CCT Plus LLC only, not with Apple, and Apple is not responsible for Tobi or its content. Apple has no obligation to provide maintenance or support for the app. To the extent permitted by law, Apple has no warranty obligation with respect to the app, and any claims relating to the app’s failure to conform to any warranty are our responsibility. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-parties list, and you agree to comply with applicable third-party terms when using the app.
17. Governing law
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws principles. You agree that the state and federal courts located in Texas will have exclusive jurisdiction over any dispute arising out of these Terms, except where prohibited by applicable law.
